What is the California Fair Employment and Housing Act?

The California Fair Employment and Housing Act (FEHA) protects workers from discrimination, harassment and retaliation in the workplace. Under the state law, it is unlawful to discriminate or harass a worker based on the following personal characteristics:

• Age
• Ancestry
• Religion
• Disability
• Marital status
• Medical condition
• National origin
• Race
• Color
• Sex
• Sexual orientation

The FEHA’s anti-discrimination provisions apply to employers with at least five employees. The anti-harassment provisions are more comprehensive as they apply to employers with at least one employee. All government employers are covered under state law regardless of size.

The FEHA also protects individuals from retaliation if they file a complaint, help someone else make a complaint or speak up about any workplace violations under the law. If an employer makes employment decisions such as hiring, promoting or firing workers based on any of the protected categories listed above, they are violating state law.
